Experience

Françoise Gilbert has extensive, in depth experience with data privacy and security issues, Internet, eBusiness, and information technology law. Her clients include numerous Fortune 500 and other global corporations, as well as selected emerging technology start-ups.

She advises companies on how to strategically manage their privacy, security, electronic workplace, and e-business risks, develop and implement information privacy and security strategies and compliance programs, and integrate privacy and security concerns in mergers & acquisitions, outsourcing, marketing, and other relations.

Françoise regularly addresses a wide range of privacy and security issues, from HIPAA, COPPA or CAN SPAM compliance, to Security Breach Disclosure Laws, implementation of FTC or HIPAA Security Safeguards, US Department of Commerce Safe Harbor self-certification, or foreign data protection laws (Western Europe, North America, or Asia Pacific).

She has counseled organizations on privacy and security compliance; structured data protection strategies for global expansion; assisted in incorporating privacy and security in companies’ operations, offerings, or websites; designed privacy and security policies and procedures adapted to clients’ needs and reputation. She has lead the creation and implementation of internal procedures necessary to fulfill the promises made, including, data protection programs, compliance programs, and training programs. She has organized comprehensive data collection and used programs to address privacy, security, and cross border data flow issues, including registration with Data Protection agencies, and structuring relations with third parties through due diligence, audits and data agreements.

In addition to compliance concerns, Françoise assists clients’ M&A or Marketing teams in incorporating data protection in their operations and transactions. She has worked on data protection issues in major corporate transactions such as Mergers & Acquisitions, outsourcing, and offshoring. She has also structured and negotiated a wide variety of technology related commercial transactions associated with databases, data processing or data management, including strategic alliances and joint ventures, IT procurement and outsourcing, distribution agreements, and development and systems integration projects.

 

Community Activities

A recognized expert and respected leader in technology law, privacy and information security, and ehealth since the 1980’s, Françoise Gilbert was a pioneer in the development of Telemedicine and e-Health Law, in the pre-HIPAA environment. She has advised lawmakers on policy and regulatory issues on the legal barriers to Telemedicine and e-Health.

 

Speaking and Teaching

A prolific speaker and writer, Françoise Gilbert has taught technology and data protection law in the Graduate School of Health Information Science at the University of Illinois, Chicago Campus since 1992, and has been a frequent guest speaker at John Marshall Law School in Chicago (Illinois) and at the Silicon Valley Center for Entrepreneurship at San Jose State University (California). In addition, she has been featured as a speaker throughout the United States and internationally on privacy, security, risk management, outsourcing, and e-business law and issues by industry groups, bar associations and trade associations.

 

Publications

Françoise has published extensively on information technology and data protection issues. In addition to numerous articles published in peer-reviewed publications, professional journals and magazines, she is a co-author of:

Board Memberships

Françoise is a member of the Editorial Board of The Practical Lawyers (ALI-ABA), and she serves on the Technology Board of Advisors of the ALI ABA. She has served on the Board of Directors of the American Telemedicine Association, the California E-Heath and Telemedicine Association, and other non-profit entities, and on the Board of Advisors of Silicon Valley emerging technology start-ups. She is a past member of the National Conference of Lawyers and Scientists.

Ms. Gilbert is a member of the Executive Committee of the Business Law Section of the California Bar. She is a past Chair of the Cyberspace Committee of the California Bar.

 

Education and Bar Admissions

Trained in the civil law and the common law systems, Françoise Gilbert is admitted to practice in California and Illinois as well as in France.

 

Before acquiring her JD in Chicago (Illinois), she obtained a French law degree in Paris (France). Early training included undergraduate and graduate degrees in Mathematics, engineering and education from the Universities of Paris and Montpellier (France).

 

Languages

Françoise Gilbert is bi-lingual (French and English) and she has working knowledge of Spanish, Italian and German. She is attuned to the variety of legal approaches and legal cultures in different parts of the world. She has lived in Africa and Europe before moving to the United States.
